You agree not to use the site in any way that breaches any applicable law, infringes the rights of others, or interferes with the operation or security of the site. We supply containers in a range of grades, from new to as-is condition, according to our grading system. Second-hand containers are used goods and may show signs of prior use consistent with their grade. Where we offer painting or modification services, the finished result will be as agreed with you in writing. You are welcome to inspect a container at our yard before purchase. To the extent permitted by law, descriptions and images on the website are indicative only and the actual container supplied may vary.
Unless stated otherwise, prices are in Australian dollars and include GST. Payment terms will be set out in your quote or invoice. For leases and rentals, containers are leased for a minimum of one month and then charged month by month for as long as you require, in accordance with the terms of your agreement. We reserve the right to change our prices at any time, though changes will not affect an order we have already confirmed.
We offer a lease-to-own option through our finance partner, Humm (credit provided by Once Credit Pty Limited, ABN 99 112 319 632, Australian Credit Licence No. 386194). Any finance arrangement is a separate contract between you and the finance provider and is subject to their terms, credit assessment, fees and conditions. We are not the credit provider and are not responsible for finance approval decisions. Please review the finance provider's terms and your loan schedule carefully before accepting.
We can deliver and position containers at your request, and containers can be relocated if required. Delivery is arranged using our own tilt tray for 20-foot containers and a contracted side-loader for 40-foot containers. It is your responsibility to ensure the delivery site is safe, accessible, and suitable for the delivery vehicle and container placement. Delivery timeframes are estimates only. Additional charges may apply for difficult access, waiting time, or failed deliveries where the site was not ready or accessible.
For purchases, risk in the container passes to you on delivery (or on collection, if you collect it yourself). Title in the container does not pass to you until we have received payment in full. For leased or rented containers, title remains with us at all times, and you must return the container in the condition it was supplied, allowing for reasonable wear consistent with its grade.
While a container is in your possession under a lease or rental, you agree to:
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
To the maximum extent permitted by law, and subject to the consumer guarantees referred to above, our liability to you for any loss or damage arising in connection with our products, services or website is limited to, at our option, the resupply of the goods or services or the cost of resupply. We are not liable for any indirect or consequential loss.
